Hey David,

Thank you for your response.

In regard with Section 8.3, the dependents and the LNO will have an insurance of course, however we cannot commit that in case of an accident, the dependents (only) first recourse will be against that insurance. For the LNO himself we can commit to the provision. Therefore we would like to add that only in regard to the dependents IMOD will make every effort to ensure that their first recourse is against the insurance.

In regard with Sections 5.3 and 5.4, the LNO is supposed to sign that he is aware of all the IP regulations, security laws and other procedures and regulation. As for those expectations, we just want to make sure that he will get some guidance in regards with the main provisions of the relevant regulation, and maybe that he will have a POC to contact with anytime he has questions. Please let us know if it is possible for you to explain the LNO the main regulations and maybe assign some POC for him in relation to those matters.

Best regards,

Yarin

Benzi,

Feedback is below on the two points:

Article 5.3-5.4 is legally objectionable to us, and we would not be able to comply with this. The main concern is that we cannot cover the >10,000 federal, state, and local laws, and this opens us up to significant liability and opens up many other issues.

Article 8.3 is potentially an issue because everyone in the U.S. is required to buy vehicle insurance if they are driving on U.S. roads, regardless of their status. The intent is to ensure that if they do drive, they are complying with the law, and that no liability falls back on the host command (CENTCOM)

Article 5.3 – 5.4, requires that the Liaison Officer will be familiar with the applicable law, regulation, IP rights, internal procedures, security laws and etc. Therefore we would appreciate adding language to the effect that the Host Party will ensure that the Parent Party or the Liaison Officer is made adequately aware of such laws and regulations by providing us with the relevant documents or by instructing the officer in related to those matters.

Article 8.3, requires that in case of claims related to motor vehicle, the applicant`s first recourse will be against the insurance company. Unfortunately we cannot fully commit to this provision, as IMOD do not have authority regarding the officer`s dependents.

Dave,

Please see the attached DTSA and OGC approved FLO MOA with approved language
(first pdf). I have attached the raw word doc for your reference.

Additionally, we would like a 1 star general to sign the agreement. The
individual must have the authority to conclude international agreements.

The main briefing point for this one is:

-We do not want to 'dual hat' the FLO at this time, so the language in the
final version for 2.5 reflects the original language of the FLO only
supporting one command.

We need two 'wet ink' copies from the signer, and I will send you my address
separately. Once I get them, I will route them up the chain and send you
back a final copy.

Please let me know if you have any question.

Best,
Cake
